32. NITARA RADAR - LOCATION TRACKING

IMPORTANT: Nitara Radar uses your device’s and/or your farm’s location to enable proximity-based and mapping features. Location accuracy depends on your device, connectivity, and environment, and is not guaranteed.

32.1 Nature of Nitara Radar

Nitara Radar is a location-based feature of the Nitara Platform that uses GPS, network-based positioning, or User-provided address data to enable functionality such as farm mapping, locating nearby service providers, dealers, milk collection points, or field agents, and tracking the location of registered farm assets or field visits, as made available within the relevant Nitara Platform product.

32.2 Consent and Device Permissions

Nitara Radar operates only where you have granted the relevant location permission on your device or otherwise provided location information within the Platform. You may disable location permissions at any time through your device settings; however, doing so may disable or degrade Nitara Radar and any other Platform feature that depends on location data.

32.3 Purpose Limitation

Location data collected through Nitara Radar is used solely for the purposes disclosed at the point of collection and in the Privacy Policy, including enabling proximity-based services, farm and asset mapping, operational analytics, and safety or fraud-prevention purposes. GormalOne does not use precise location data for continuous, real-time tracking of a User’s personal movements beyond what is necessary for these disclosed purposes.

32.4 Accuracy and Connectivity Disclaimer

GormalOne does not guarantee the accuracy, precision, or availability of any location data displayed or recorded through Nitara Radar. Location accuracy may be affected by device hardware, GPS signal strength, network connectivity, indoor or obstructed environments, and other technical factors beyond GormalOne’s control. You should not rely on Nitara Radar as the sole basis for any safety-critical, operational, or time-sensitive decision.

32.5 Data Minimization and Coarse Location for Reporting

Where location data is used for analytics, dashboards, or reporting purposes, GormalOne may store or display such data at a coarse, district- or region-level granularity rather than precise coordinates, consistent with GormalOne’s data minimization practices described in the Privacy Policy.

32.6 Data Processing Consent

By enabling Nitara Radar or granting location permissions, you consent to the collection, storage, and processing of your location data in accordance with these Terms, the Privacy Policy, and Article 12 (Data Ownership, Processing, and Privacy) of these Terms, including applicable requirements under the Digital Personal Data Protection Act, 2023 and rules made thereunder.

33. GENERAL PROVISIONS

33.1 Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed from these Terms and the remaining provisions shall continue in full force and effect.

33.2 Waiver

No failure or delay by GormalOne in exercising any right, power, or privilege under these Terms shall operate as a waiver of that right. A waiver in one instance shall not constitute a continuing waiver. All waivers must be made in writing and signed by an authorized representative of GormalOne.

33.3 Assignment

You may not assign, transfer, or delegate any of your rights or obligations under these Terms without GormalOne's prior written consent. GormalOne may freely assign these Terms, in whole or in part, including in connection with a merger, acquisition, restructuring, or sale of assets, without your consent.

33.4 Entire Agreement

These Terms, together with the Privacy Policy, and any additional product-specific agreements or enterprise service agreements entered into with GormalOne, constitute the entire agreement between you and GormalOne with respect to the Platform and supersede all prior agreements, understandings, representations, and negotiations.

33.5 Survival

The following provisions shall survive termination or expiry of these Terms: Intellectual Property Rights, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Dispute Resolution, Data Ownership, Grievance Redressal, and all other clauses which by their nature are intended to survive.

33.6 Notices

All legal notices to GormalOne must be sent in writing to the address stated in Clause 34 (Contact Information). GormalOne may provide notices to you via your registered email address, SMS, in-app notification, or push notification. Email notice to your registered email constitutes valid legal notice under the IT Act, 2000.

33.7 Language

These Terms are executed in the English language. In the event of any translation into another language, the English language version shall prevail.

33.8 Equitable Relief

You agree that a breach of Clause 6 (Prohibited Activities), Clause 15 (Intellectual Property), or your confidentiality obligations under these Terms may cause irreparable harm to GormalOne for which monetary damages would be an inadequate remedy, and that GormalOne shall be entitled to seek injunctive or other equitable relief from a competent court without the requirement of posting a bond or proving actual damages.

33.9 Supplemental Terms

GormalOne may offer specific features, products, or programs that are subject to supplemental terms and conditions ("Supplemental Terms"). Supplemental Terms will be made available at the relevant feature, product, or program level.
